DAVID R. HAZOURI, admitted to bar, 1998, Florida; 1995, New York. Mr. Hazouri is a twelve year attorney specializing in commercial civil litigation. Prior to his association with the firm, Mr. Hazouri was a partner in the litigation division of Bilzin Sumberg Baena Price & Axelrod. Throughout his practice, Mr. Hazouri has participated in a broad variety of matters in both state and federal courts, as well as arbitration tribunals. These matters have included lender liability, corporate and partnership disputes, intellectual property rights, probate, receiverships, creditor's rights, NASD violations, zoning and code compliance, landlord/tenant, mass tort, employment law, and federal bankruptcy proceedings.

REPRESENTATIVE CASES:
  • Represented the U.S. Litigation Trustee and Plan Administrator for Lernout & Hauspie Speech Products, N.V., in a suit against KPMG, LLP, and its Belgian counterpart, KPMG Belgium, seeking damages of over $300 million dollars for improper accounting practices related to management's fraudulent revenue recognition.*
  • Defended a prominent financial institution in two separate class actions involving allegations of aiding and abetting, breach of fiduciary duty and violation of the Bank Secrecy Act. *
  • Defended a specialty products manufacturer against trade secret and unfair competition claims brought by Nicholas Perricone, M.D. *
  • Filed trade name/trade dress infringement claims that settled favorably on behalf of a Puerto Rican beverage manufacturer. *
  • Defended a super-abrasives start-up company against claims brought by the division of a multinational conglomerate alleging unfair competition, FUDTPA violations, and trade secret misappropriations.*
  • Defended an intellectual property claim against a toy manufacturer brought by Volkswagen, USA. *
  • Represented a national public communications company sued in a wrongful death case of a minor relating to all insurance coverage questions, including duty to defend, indemnity issues and coverage for punitive damage allegations. Successfully obtained coverage for defense of the matter and coverage for the punitive damage claims. *
  • Represented a fine crystal manufacturer in successfully obtaining and executing upon a prejudgment writ of replevin seeking the return of property from former franchisee.*
  • Represented Surfside Emergency Associates in non-compete claims involving emergency medical staffing group contracts. *
  • Defended a seasonal fireworks company in two municipalities concerning land use issues. *
  • Represented internet start-up company in claims of breach of shareholders agreement and trade secret misappropriation.*
  • Represented a foreign personal representative of Italian decedent in gathering contested assets held in Florida bank account.*
